Important: OpenSiteCheck is a first check for accessibility problems. It is not a complete audit or WCAG certificate, cannot tell you whether a law applies, does not give legal advice, and does not guarantee that a suggested fix is correct.

1. Agreement and eligibility

These Terms are an agreement between you and LATTY INTERACTIVE LLC, which operates Accessibility by OpenSiteCheck. By submitting a scan, creating an account, or purchasing or using a report, you agree to these Terms and acknowledge the Privacy Policy.

You must be at least 18 and able to enter a binding agreement. If you act for a company, client, or other organization, you confirm that you have authority to bind it. "You" includes that organization.

United States business beta

Paid reports in the public beta are offered only to United States businesses and people purchasing for business or professional purposes. They are not offered for personal, family, or household use. You must make that confirmation before paid checkout. The free scanner may remain technically reachable from other locations, but we do not represent that paid services are offered or lawful in every jurisdiction.

2. What the service provides

OpenSiteCheck opens public web pages in a browser, runs automated accessibility checks, groups related problems, and may use AI to draft explanations and code suggestions. Depending on the report you choose, it can follow links on the same website, use a list of URLs you provide, read a sitemap, save report history, and create online, HTML, or PDF reports.

A plan's page limit is the maximum number of URLs we will attempt in one report, not a promise that every page will load or be testable. A site may block automated browsers, redirect, time out, return an error, or expose fewer eligible pages. Incomplete pages may still appear in the report.

Tier names, prices, page limits, discovery methods, and included formats shown at checkout form part of the order. Paid reports are one-time purchases, not subscriptions, unless a future order clearly says otherwise.

3. Public and authorized scanning only

You may submit only publicly reachable HTTP or HTTPS pages. Do not submit credentials, authenticated pages, private network addresses, staging sites containing confidential data, signed or secret URLs, or pages containing personal, regulated, or sensitive information.

For a paid multi-page report, you confirm that you own or are authorized by the owner to test every listed website. You are responsible for the legality of the URLs and content you submit and for having any permission needed to let us access, process, store, and transmit the relevant public-page content as described in the Privacy Policy.

Discovery follows applicable robots.txt rules for additional sitemap and crawl URLs. A starting URL you explicitly submit remains a user-directed scan request. We identify automated scanner requests with an OpenSiteCheck user agent and use rate limits and domain locks to reduce load.

A website representative may request removal of a stored report. We may also stop or restrict scans involving a domain when needed to prevent abuse, protect rights, comply with law, or preserve service reliability.

4. Accounts and security

You must provide accurate account information, protect your password and session, and promptly tell us about suspected unauthorized use. You are responsible for activity performed through your account unless caused by our breach of these Terms or failure to use reasonable security.

Free account quotas apply per account and calendar month. You may not create multiple accounts or use automation, rotating identities, or other means to evade a quota, cooldown, block, or rate limit.

5. Paid reports, payment, and delivery

Prices are stated in US dollars. OpenSiteCheck does not add US sales tax to initial-beta purchases of the one-time automated report. PayPal processes the fixed total we provide and does not calculate tax for us. We monitor nexus and revenue and may revise this treatment before an applicable threshold or if our obligations or the service change. The payment provider displayed at checkout processes payment credentials under its own terms and privacy notice; OpenSiteCheck does not store your full card, bank, or PayPal credentials.

After payment is successfully captured, we create or release one scan job for the purchased tier. Fulfillment begins promptly and may be asynchronous. A completed paid report includes the formats listed with the plan. Email delivery is a convenience; the online and downloadable report remain the primary delivery methods.

A report covers only the submitted website and the pages selected or discovered for that purchase. It does not include ongoing monitoring, another scan in the future, work on your website, certification, legal review, or a guarantee that every problem will be found.

6. Refunds, retries, and cancellations

This section is the OpenSiteCheck Refund Policy. It is included here so purchase, delivery, and refund terms stay in one agreement.

When a paid report fails

If the complete paid report cannot be delivered because of an OpenSiteCheck system failure, contact us within 14 days of the failed job. We will provide one reasonable retry or replacement scan at no additional charge. If that retry also cannot produce the purchased report, we will issue a full refund to the original payment method.

Other refunds

  • We will refund a verified duplicate charge.
  • If we discontinue a paid job before starting it and cannot provide an equivalent report, we will refund it.
  • If a cancellation request reaches us before the paid scan starts, we will cancel and refund it where operationally possible.

What does not by itself qualify

A refund is not due solely because one or more target pages are unreachable, blocked, redirected, incomplete, or absent from a sitemap; because a report detects no issues or more issues than expected; because an AI suggestion is missing, incomplete, or unsuitable; because you disagree with an automated grade; or because email delivery fails while the report remains available online or for download.

No refund is due for an unauthorized, prohibited, or materially incorrect target submitted by you, or for service suspension caused by your breach of these Terms. These rules do not limit rights that cannot legally be excluded.

How to request help

Email support@opensitecheck.com with the purchase email, payment order ID if available, report link, and a short description. Do not send payment credentials. Approved refunds are sent through the original payment provider and may take additional business days to appear.

7. Submitted content, reports, and intellectual property

You retain any rights you have in information you submit. You grant us a limited, non-exclusive right to access, reproduce, analyze, transmit, and store submitted URLs and public-page content only as reasonably needed to provide, secure, troubleshoot, and improve the service, meet retention obligations, and respond to valid requests.

You do not gain rights in a third party's website by scanning it. We do not claim ownership of target-site content. OpenSiteCheck and its software, design, documentation, branding, and report templates remain ours or our licensors'. axe-core and WCAG-related materials remain subject to their respective rights and licenses.

Subject to these Terms, you may use and share your report inside your business and with an authorized client, developer, adviser, or accessibility specialist. Agencies may use reports for authorized client work. You may not present an automated report as a manual audit, certificate, legal opinion, or endorsement by OpenSiteCheck, Deque, W3C, or another organization.

AI suggestions are non-exclusive, may be generated from public markup, and may be reused for the same technical pattern. They may resemble output supplied to another user and are not promised to be original, copyrightable, or free of third-party rights. Review them before use.

8. Acceptable use

You must not:

  • scan a page you are not permitted to test where permission is required, or use the service to harass, surveil, threaten, or burden a person or website;
  • submit private, authenticated, confidential, illegal, malicious, or sensitive content;
  • use the service as a proxy, vulnerability scanner, penetration-testing tool, crawler, scraping service, or means to bypass access controls;
  • interfere with, overload, reverse engineer, or attempt unauthorized access to the service, its accounts, reports, infrastructure, or data;
  • evade quotas, cooldowns, domain locks, blocks, payment controls, or security measures;
  • resell access to the service or systematically extract and redistribute its software, prompts, templates, or bulk report data without written permission; or
  • use a report or suggestion unlawfully or represent it as a guaranteed compliance result.

9. Important limitations and disclaimers

Automated tools can check only part of a website's accessibility. OpenSiteCheck tests the listed public URLs as they appear at that time. It does not test every WCAG requirement, user journey, screen size, interaction, document, app, assistive technology, content decision, or legal requirement.

The severity labels and A-F automated grade help you decide what to fix first. They are not legal-risk ratings, WCAG A/AA/AAA levels, or accessibility certificates. If the automated checks find nothing, that does not mean the page is accessible or legally compliant.

AI-written explanations and code suggestions can be wrong, incomplete, insecure, or unsuitable for your website's components, framework, styles, content, or users. A person must review, implement, and test the suggestions and decide how to use the report.

To the maximum extent permitted by law, the free service, beta features, reports, suggestions, downloads, and site are provided "as is" and "as available." We do not warrant uninterrupted availability, error-free operation, a specific completion time, detection of every issue, fitness for a particular purpose, or a compliance outcome.

10. Limitation of liability

To the maximum extent permitted by law, neither party will be liable under these Terms for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profit, revenue, opportunity, goodwill, business interruption, or loss of data, even if advised that those damages are possible.

To the maximum extent permitted by law, our total liability arising from a paid report will not exceed the amount you paid for the report giving rise to the claim. Our total liability for a free service will not exceed US$100.

These limits do not apply where liability cannot legally be limited, or to fraud, willful misconduct, or gross negligence. You are responsible for claims arising from your unlawful submission, lack of authorization, infringement of third-party rights, or material breach of these Terms, to the extent permitted by law.

11. Suspension, termination, and service changes

We may limit, suspend, or terminate access when reasonably necessary to address abuse, security, legal risk, nonpayment, prohibited content, a target-owner request, or a material breach. We may change or discontinue free or beta features. Where practical, we will give notice of a material change affecting a paid report that has not yet been delivered.

You may stop using the service at any time and may request account deletion under the Privacy Policy. Terms that by their nature should survive, including payment, report-use, disclaimer, liability, dispute, and retained-record provisions, continue after termination.

12. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming and applicable United States federal law, without regard to conflict-of-law rules. Before filing a claim, each party will give the other written notice and 30 days to try to resolve it informally.

Subject to any court jurisdiction that cannot be waived, the state courts located in Natrona County, Wyoming, and the United States District Court for the District of Wyoming have exclusive jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

If one provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them with a merger, reorganization, asset transfer, or sale of the service.

13. Changes, notices, and contact

We may update these Terms for product, security, operational, or legal reasons. Material changes apply prospectively and will be communicated through the site, account, or email where appropriate. The terms presented when you place a paid order govern that order unless a later change is required by law or you agree to it.

Questions, refund requests, and formal notices may be sent to support@opensitecheck.com or to the mailing address above. See Contact and takedowns for the information to include.
